1. Acceptance of Terms

By accessing https://www.unburdenedlabs.com and purchasing products, you agree to be bound by these Terms of Service and all applicable federal, state, and local laws. These terms apply to all users of the site, including browsers, vendors, and customers. If you do not agree to all terms, you are prohibited from using this site or purchasing our products.

2. Intellectual Property Rights

All content on this website—including text, branding, logos, product formulas, videos, and photography—is the exclusive property of Unburdened Labs. You are granted a limited license only for purposes of viewing the material contained on this website. You may not modify, reproduce, or redistribute any materials for commercial purposes without express written consent.

3. Product Information & Regulatory Compliance

• Cosmetics & Fragrances: Our fragrances and body products are classified as cosmetics under the FD&C Act. They are intended for topical, external use only.
• Soap Classification: Products marketed strictly as “soap” meet the CPSC (Consumer Product Safety Commission) definition, composed primarily of fats and alkalis without added cosmetic claims.
• Handmade Variance: Since products are produced in small batches in Rhinelander, WI, slight variations in color, texture, or scent may occur. These are characteristic of artisanal production and do not constitute a product defect.
• Usage Responsibility: It is the customer’s responsibility to read all ingredient lists provided to avoid known allergens.

4. Safety, Liability, and Proper Use

• Sensitivity & Allergic Reactions: We strongly recommend performing a “patch test” using the provided 2ml sample before full application. Unburdened Labs is not liable for any adverse physical reactions, skin irritations, or medical issues arising from the use or misuse of our products.
• Flammability Warning: Fragrance products contain high concentrations of alcohol. Keep away from heat, sparks, open flames, or hot surfaces. Do not smoke while using.
• General Safety: Products are not for internal consumption. Keep all products, including car diffusers and concentrated oils, out of reach of children and pets. Car diffusers must be secured to prevent leakage, which may damage vehicle interiors; Unburdened Labs is not liable for property damage caused by leaking diffuser oil.

5. Shipping and Hazardous Materials (HAZMAT)

• Ground Shipping Only: Due to the alcohol content in Eau de Parfums (Class 3 Flammable Liquids), we ship exclusively via USPS Ground Advantage or other ground-based carriers within the contiguous United States to comply with DOT (Department of Transportation) and USPS Publication 52 regulations.
• Risk of Loss: All items purchased are made pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery to the carrier. We are not responsible for packages stolen after a verified carrier delivery.

6. Sales and Financial Transactions

• Payment Processing: All transactions are processed through Square. By purchasing, you agree to Square’s terms and conditions.
• Taxes: Sales tax will be applied to orders as required by Wisconsin state law and the destination state’s nexus laws.
• Order Refusal: We reserve the right to refuse or cancel any order for any reason, including suspected fraud or unauthorized commercial resale.

7. Limitation of Liability

To the maximum extent permitted by Wisconsin law, Unburdened Labs, its owner, and employees shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our products or the inability to use this website. Our total liability for any claim shall not exceed the purchase price of the product in question.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin. Any disputes arising from these terms or your use of the site shall be resolved exclusively in the state or federal courts located in Oneida County, Wisconsin.

9. Indemnification

You agree to indemnify and hold harmless Unburdened Labs from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms or your violation of any law or the rights of a third party.
